A child is recovering after being hit by a car at the bus stop.
It happened at 6:17 a.m. Thursday morning just south of Castalia in Nash County on Highway 58.
Authorities tell 9 On your Side that the school bus was stopped with its arm extended when 41-year-old Nicholas Benitez failed to stop.
13-year-old Jesus Ortiz was hit in the incident. He was taken to Nash General with facial cuts and a broken leg.
Benitez is charged with felony failure to stop for a stopped school bus, unsafe tires, and having a revoked license.
He was arrested and booked. Police say Benitez had 3 outstanding warrants for unrelated crimes.
Those warrants are all from 2011; possession of an open
container in the passenger seat, revoked tags, and no operator's license.
