NC Court of Appeals: Michael Peterson should get new trial

DURHAM, N.C. -

The North Carolina Court of Appeals issued a ruling Tuesday morning claiming Durham author Michael Peterson should get a new trial in the 2001 murder of his wife Kathleen Peterson.

In 2003, Peterson was sentenced to life in prison for the murder of his wife.  She died in their mansion 10 years ago.

After serving eight years behind bars Peterson, 68, was released following a ruling that former State Bureau of Investigation agent Duane Deaver, a key prosecution witness, misled jurors about the strength of bloodstain evidence.

Judge Orlando Hudson ruled that Deaver misled jurors at Peterson's trial when he testified that his analysis of blood spatter showed beyond any doubt that Kathleen Peterson died after being struck by her husband three times with a blunt object.
