911 call released in Jacksonville Marine shooting case

A man who called 911 after a shooting in Jacksonville last week says he shot an intruder inside his home.

In a 911 tape obtained by 9 On Your Side, the caller says he did not know the man who broke into his home.

Corporal Benjamin Marisic was taken into custody last Friday after police say he shot and killed 39-year-old Dale Smith, a former Florida deputy sheriff. Smith was working as a civilian contractor.

The shooting happened at Marisic's home on Savannah Drive in Jacksonville. In the call the man says he has a roomate but doesn't know if they were home at the time.

Police have not confirmed if the voice heard on the 911 call is that of Cpl. Marisic.

Naval Criminal Investigative Service is assisting in the investigation.

Marisic is in the Onslow County Jail. His next court date is set for August 29.


A Camp Lejeune Marine charged with murdering a former Florida deputy sheriff will have his first court appearance Monday in Jacksonville.

Court Records show a hearing for 24-year-old Benjamin Marisic will happen Monday morning.

 Marisic was taken into custody Friday morning. Marisic is an active-duty Marine stationed at Camp Lejeune. He's in the Onslow County Jail without bond, facing murder charges.

The victim has been identified as Dale Smith, 39, of Crestview, Florida. Smith was employed as a civilian contractor.

Officers were called to 713 Savannah Drive around 3:45 Friday morning. We're told they found Smith with a gunshot wound.

According to investigators, Marisic lives at the home where the shooting took place.

Naval Criminal Investigative Service is assisting in the investigation.

"The investigation is in the preliminary stages and there is no additional information to release at this time." stated Lieutenant Ronnie Dorn, supervisor in the Investigative Services Division.
