Court rules new trial for NC man serving life

RALEIGH, N.C. -

(AP) - North Carolina appeals judges say a man convicted of sex-related crimes that two sisters alleged occurred against them more than 20 years ago should get a new trial because of errors in court.

Robert T. Walston Sr. of Dare County has been serving life in prison after a jury last year convicted him of several crimes. The state Court of Appeals ruled Tuesday in favor of a new trial.

The appeals judges say the trial judge erred by excluding testimony by those who say Walston was respectful around children and interacted with them positively. They say the trial judge also shouldn't have referred to "victims" in the jury instructions, as opposed to "alleged victims."

The sisters allege the offenses occurred in the late 1980s when they were children.
