Johnson, Not Guilty of Rape

It's the verdict the Johnson family had hoped for, "It frees both families," says Johnson's uncle Louis Mobley. "I think it's a good thing. Thank God for the justice system."

Former high school football wide receiver Deon Johnson is not guilty of raping a girl in Spanish Fort two years ago.

Family members left court with tears of joy. For defense attorney John White, relief. "He's very, very pleased," says White about Johnson's reaction to the verdict. "I can't go into great detail about what he said but, pleased."

The case came down to, who do you believe? Short on physical evidence because of a delay in reporting the alleged crime and a further delay in investigating it.

"Anytime there is a delay, for whatever reason, it hinders my ability to do my case," says assistant district attorney Teresa Heinz. Prosecutors say the jury obviously had issues with prior consensual acts between the alleged victim and Johnson.

"They looked at everything, weighed everything and really glad obviously that they came back with a not guilty," says White.

"I'm disappointed with the jury's verdict," says Heinz, "and I think they got it wrong. I think they got it wrong this time."

Johnson's uncle says in the end, there really aren't any winners. "It's a tragedy that both kids had to go through this."

Johnson has spent the better part of two years in the Baldwin County Jail and he is back there now.

He still faces two other rape cases. His attorney says he will try to get him released on bond. Prosecutors say they will fight it.
