RALEIGH, N.C. (AP) – North Carolina’s highest court has sided with Gov. Pat McCrory by deciding the General Assembly went too far in how legislators appointed members of some state environmental commissions.

A majority of justices on the state Supreme Court ruled Friday in favor of McCrory and two former governors who sued legislative leaders in 2014.

The House speaker and Senate leader were designated to choose a majority of the positions on each commission. And a law ordered the Coal Ash Management Commission to act independently of McCrory’s environmental agencies

Chief Justice Mark Martin said the appointment provisions for the commissions prevented the governor from “performing his constitutional duty to take care that the laws are faithfully executed.”
