GREENVILLE, N.C. (WNCT) – The same judge who officially sentenced Antwan Anthony to death in this year’s high-profile Hustle Mart murder trial will hear a motion on whether there will be a new trial or a new sentencing.

Senior Resident Superior Court Judge Marvin Blount III signed the order on Thursday bringing Superior Court Judge Robert Hobgood back to Greenville. Judge Hobgood is based in Raleigh.

On April 5, Judge Hobgood formally sentenced Anthony to death following the jury’s recommendation. The jury previously found Anthony guilty of killing three Hustle Mart employees in Farmville in 2012.

Last week, Anthony’s attorney filed a motion saying a juror was improperly influenced from overhearing outside the courtroom what a Pitt County Sheriff Office employee was saying to a bailiff about what should happen to Anthony.

Thursday’s order also protects any courthouse surveillance videos from the trial. This includes any video from inside and outside the courtroom from February 8, 2016 to April 5, 2016.
